President Luiz Inácio Lula da Silva has signed Bill No. 576 of 2021, which regulates the use of offshore energy potential. Offshore energy generation is carried out through wind turbines installed on fixed or floating platforms on the seabed. It is a renewable and clean energy source that harnesses the power of the wind, particularly offshore, where winds are faster, more constant, and free from obstacles, making it more productive than onshore wind energy. Another difference is that the wind turbines used offshore are larger than those on land. The measure was published in an extra edition of the Official Gazette (DOU) on Friday, January 10.

The signed law represents the regulatory framework for offshore energy in the country, establishing guidelines for the use of energy potential in areas under federal jurisdiction, such as territorial waters, the exclusive economic zone, and the continental shelf, focusing on the generation of electricity from renewable sources.

Incentives
The text also provides incentives for the development of the national industry, job creation, and the strengthening of the country's energy security, integrating economic and environmental aspects. To ensure the sustainability of activities, the law establishes requirements for decommissioning projects and restoring exploited areas, as well as mandates prior consultations with affected communities, promoting respect for traditional maritime practices and local culture.

Revenue
Revenue generated from signing bonuses, occupancy fees, and proportional participation in energy production will be distributed between the federal government, states, and municipalities, with investments primarily directed toward research, technological innovation, and sustainable development.

Advancement
Brazil ranks sixth in the world for wind energy production. With the new law, the country could drive a significant shift in the generation of clean and renewable energy, responding to increasing demand, reducing costs, and boosting the local industry. Offshore wind energy is a new source in Brazil, with no platforms installed so far due to the lack of legislation.

Vetoes
The presidential vetoes represent a course correction by removing provisions unrelated to offshore wind energy generation that were not part of the original proposal. These are Articles 22, 23, and 24.

These provisions go against the signed law, as they aim to maintain more polluting, costly, and inefficient energy sources like coal and gas-fired thermoelectric plants, for example, as well as changes to tariff adjustment indices, setting a less favorable parameter for the population. In summary, these measures would affect citizens' pockets and disrupt public finances, with estimated costs running into billions.

The presidential sanction aims to position Brazil as a leader in the global energy transition, aligning with the main trends in the exploration of renewable energies and reinforcing its commitment to environmental sustainability, economic development, and the reduction of regional inequalities.
