The ANP draft resolution on transparency in the pricing of oil, natural gas and biofuel derivatives will be broken down into three: a specific one for natural gas; another focused on the production, import and distribution segments of petroleum derivatives and biofuels; and a third, directed at the resale of automotive liquid fuels and LPG. The directorate of the Agency authorized today (14/2), the public consultation, for 15 days, for the draft resolution on production, import and distribution of petroleum products and biofuels. The Public hearing will be held on 20/3. The other two motions for resolutions are under discussion in the Agency.

 

The decision of the ANP aims to give market players and society at large the opportunity to express themselves once again, in view of the changes promoted in relation to the original proposal.

 

The new resolutions are the result of studies initiated in the second half of 2018 on regulatory options to increase transparency in the pricing of oil, natural gas and biofuel derivatives.

 

The main points of the draft resolution that will be put to consultation, which aim to increase transparency in price formation, specifically in the stages of production, import and distribution, are:

 

- Obligation on producers and importers of petroleum derivatives defined as dominant agents (market share of more than 20% in the macro-region of activity) to publish, on the company's website, the list price (price for cash payment, broken down by product , mode of sale and delivery point). The effect of this arrangement would begin fifteen days after the resolution was published.

 

- Inclusion as the prerequisite approval of contracts between dominant agent (the primary delivery) and distributor, parameterized price agreed between the parties, broken down by product and delivery point, formed by fixed parameters or exogenous variables, which is clear, objective and subject to prior calculation by the economic agents participating in the contract and by the ANP.

 

- Requirement, in accordance with ANP Resolution 729/2018, for all distributors, producers and importers of petroleum derivatives and biofuels to forward information to the ANP, through i-Simp, of the unit value of the product and of the modality of freight, for the sale of oil products and biofuels. This information could be made available to society by means of aggregated statistics by municipality, UF or macro-region in the case of non-dominant suppliers and distributors in order to preserve information covered by legal secrecy or minimize possible anticompetitive effects. With gradual effects by type of product, as described in manuals available on the ANP site, to be updated. Currently, distributors of aviation fuel are already attending the new command.

 

- Obligation on all distributors, producers and importers of petroleum products to supply, when requested, additional information concerning the prices charged for the marketing, including its components or its training process. This information may be used for the dissemination of aggregated statistics to society, including with lag. In addition, they may be shared with other state entities (CADE, MPs, etc.), by guaranteeing the preservation of legal secrecy. The effect of the device would begin fifteen days after the resolution was published.
