The CISG (United Nations Convention on Contracts for the International Sale of Goods of 1980) is responsible for the law’s unification and flexibility on international sales of goods among

its 79 member– countries since April 1, 2014, Brazil is the 79th member- country in which the convention has entered in force.

The convention’s application is a victory for Brazil’s international business. The CISG potentially covers 80% of international trade and is already applicable to the main partners of Brazil

around the world such as China, the United States, France, Canada and many Latin-American countries. 

Once the convention is in force, the parties of an international sale agreement may opt between the regulation of the CISG or the Brazilian Civil Code and, if applicable, the CISG’s regulation

will bring extended security and flexibility for the parties. This is due to the fact that CISG’s application must follow international courts’ orientation and because the CISG allows the parties to

exclude any of its own regulations, granting further autonomy to the parties than the national law itself.

With the CISG in force, Brazilian legislation currently offers the most modern and flexible legislative alternative for its investors. The CISG represents Brazil’s consolidation in global

economy and is an important mean to facilitate and to transform business in Brazil. After some years developing business abroad and reaching records of international investment,

Brazil is now ready to go further.
