Resolution 820 was published today (6/17) in the Official Gazette (DOU), which updates ANP Resolution 816/2020. The purpose of the review is to improve the regulation to facilitate understanding and application by regulated agents.

The new version of the resolution ratifies the prioritization of document delivery by the Electronic Information System (SEI), but provides for the acceptance of documents signed electronically (signed by the ICP-Brazil system or signed directly at the SEI).

Another important innovation concerns the permission to start or restart operations due to interruptions. With the exception of situations of interruption caused by sudden reductions in POB (personnel on board) or by demobilization of personnel due to the suspicion or confirmation of COVID-19, and with the exception of the situation of beginning of operation, the other hypotheses of restart will be exempted from the presentation of the documentation required by Resolution 816/2020.

The new version of the resolution also extends the deadlines for the delivery of Local Content reports and suspends the deadline for delivering the compositional analysis of the defined natural gas ANP Resolution 40/2009 (which establishes the criteria for setting the reference price for natural gas for the calculation of government shareholdings).

Resolution 816/2020 was published on 4/20/2020 with the purpose of defining procedures to be adopted by agents regulated by the ANP that operate in the activities of exploration and production of oil and natural gas while the temporary measures to deal with the emergency of public health due to the Coronavirus (Covid-19).

The resolution brought relaxation of contractual obligations in the exploration and production phase of contracts, including aspects of operational safety and the environment, reference price for natural gas, investments in Research, Development and Innovation, local content, and conditions for access to the ANP Database.

The measures adopted by the ANP benefit the sector and contribute to the maintenance of oil and natural gas exploration and production activities.
