Regulation of social participation in its regulatory decisions has public consultation released by ANP

The ANP started today (01/27) a public consultation on the draft resolution that includes its instruments of social participation, such as prior consultation, public consultation and public hearing. The objective is to update the rules on ways of receiving contributions from the market and society on the Agency's regulatory activity, adapting them to changes in legislation and new technological solutions.

 

The proposal seeks to regulate and encourage participation in ANP regulatory decisions, not only of the thousands of regulated agents at all stages of the production, distribution and resale chain, but of society as a whole, also impacted by the Agency's regulation.

 

Currently, the subject is regulated by two ANP resolutions: Resolution ANP No. 5/2004, which provides for the public hearing process; and ANP Resolution No. 822/2020, which regulates the holding of public hearings by videoconference, due to the state of emergency of international public health resulting from the Covid-19 pandemic.

 

The new resolution consolidates the rules on the subject, considering the changes made to the current legislation on obligations and duties of regulatory agencies regarding the conduct of public consultations and hearings, as well as the technological advances that have led to the emergence of new platforms for social participation.

 

Thus, the provisions proposed in the draft contribute to increasing social participation and transparency in ANP decisions. An example is the regulation of the remote public hearing, which allows to increase the number of participants and reduce their costs, since they do not need to travel to the physical location of the hearing. In addition, public hearings are now recorded on video and made available on the internet, increasing their reach.

 

The draft resolution will be in public consultation for 45 days and the hearing on the topic will take place on 3/31.
