ANP Resolution 839/2021 was published today (03/02), which establishes the levels of risk associated with the exercise of economic activities authorized by the ANP. The new regulation revises and repeals Resolution 826/2020, which dealt with the same issue.
By the previous rules, of the acts of liberation of economic activities of ANP's competence, only one, related to the registration of dye for anhydrous ethanol, was exempted from authorization because it was classified in the lowest level of risk. With Resolution 839/2021, the Agency exempts six more activities from the need for authorization and simplifies the process related to authorization for the exercise of the supply point activity. Activities related to acts such as approval of solvent quotas and monthly orders for liquid fuels, for example, are among those released.
The classification of economic activities authorized by the Agency follows the terms of Decree No. 10,178 / 2019, which regulated Law No. 13,874 / 2019 (known as the Economic Freedom Act). To carry it out, the ANP used a methodology that takes into account the probability and severity of the identified risks, as well as the use of tools adapted to the particularities of the activities.
