The ANP Board approved today (July 10) the holding of a 45-day public consultation and a public hearing on a draft resolution regulating non-discriminatory and negotiated access for interested third parties to production flow pipelines and natural gas treatment or processing facilities.

The initiative aims to expand social participation and obtain contributions from society to improve the proposal, developed within the scope of the ANP Regulatory Agenda for the 2025-2026 biennium (Action No. 2.10), in compliance with Article 28 of Law No. 14,134/2021, known as the New Gas Law.

The draft resolution considers aspects related to: subsidiary application of provisions of the New Gas Law regarding natural gas transportation; provision of fair and adequate remuneration for the agents involved; definition of assumptions for negotiated and non-discriminatory access; rules for infrastructure access processes; transparency measures and data availability; adaptation of contracts and instruments to the new regulatory provisions; as well as guidelines related to the capital bases of flow and processing activities.

The text also includes mechanisms aimed at reducing information asymmetry between agents and regulatory supervision of activities, including provisions related to accounting separation and the provision of additional information by vertically integrated agents.

The regulatory process began in 2022, with the creation of a working group involving different technical areas of the ANP to prepare studies on the subject. In the initial stage, preliminary studies, prior consultation, and a workshop with sector agents and other interested parties were carried out, which supported the preparation of the Regulatory Impact Analysis (RIA).

After the completion of the RIA, the regulatory proposal underwent revisions resulting from the publication of Decree No. 12,153/2024, which amended provisions of Decree No. 10,712/2021 and brought new guidelines related to access to natural gas flow, treatment, and processing infrastructures. The matter was also analyzed by the Federal Attorney's Office at the ANP.
