The guidelines for complying with ANP Resolution 868/2022 are available on the ANP website, which provides for the submission to the Agency of daily data on fuel inventories. The Resolution enters into force on March 1, 2022, but there are specific deadlines for each type of regulated agent to start sending information.

The agents that must comply with the new Resolution are: petrochemical plants; ethanol producer cooperatives; aviation fuel distributors; liquid fuel distributors; LPG distributors; ethanol trading companies; gasoline and diesel oil formulators; terminal operators; natural gas processors; biodiesel producers; ethanol producers; oil refiners; and pipeline conveyors.

These agents must send data referring to the following products: biodiesel; regular A gasoline and premium A gasoline; regular C gasoline and premium C gasoline; aviation gasoline (GAV); liquefied petroleum gas (LPG); diesel oil A S10; diesel oil A S500; diesel oil A non-road; diesel oil B S10; diesel oil B S500; non-road B diesel oil; marine diesel oil; anhydrous ethanol; hydrous ethanol; fuel oil and marine fuel oil and aviation kerosene (QAV).

As of March 1, regulated agents will be able to send data to the ANP. However, submission only becomes mandatory after the deadline determined by the Resolution. With this, the ANP allows companies to adapt and clear their doubts with the Agency before they are, effectively, obliged to send the data. The deadlines for sending data are:

  • 11/18/2022, for the aviation fuel distributor (270 days after publication of the Resolution);
  • 12/19/2022, for the terminal operator, the biodiesel producer, the pipeline carrier and the LPG distributor (300 days after the publication of the Resolution);
  • 01/17/2023, for the petrochemical plant, the liquid fuel distributor, the gasoline and diesel oil formulator, the natural gas processor and the oil refiner (330 days after the publication of the Resolution); and
  • 02/16/2023, for the cooperative of ethanol producers, the ethanol trading company and the ethanol producer (360 days after publication of the Resolution).

On the ANP page, channels are also available for regulated agents to clarify doubts.
