Yesterday (01/13/2022) the ANP Collegiate Board approved the public notice and contracts for the ANP Public Call No. 03/2021, which aims to contract the firm capacity available in the Bolivia-Brazil Gas Pipeline (Gasbol) for the years from 2022 to 2026 by shippers, authorized by the Agency, interested in contracting the natural gas pipeline transport service.


The draft documents were submitted to the industry and society by the ANP through Public Consultation No. 21/2021 (https://www.gov.br/anp/pt-br/assuntos/consultas-e-audiencias-publicas/consulta -audiencia-publica/consulta-publica-no-21-2021), to receive comments. Based on the suggestions accepted by the Agency, Transportadora Brasileira Gasoduto Bolivia-Brasil S/A (TBG) prepared revised versions of the public notice and the transport service contract that were considered today by the Collegiate Board of Directors of the ANP.


According to MME Ordinance No. 472/2011 and ANP Resolution No. 11/2016 (https://atosoficiais.com.br/anp/resolucao-n-11-2016?origin=instituicao&q=11/2016), the ANP is responsible for supervising all stages of the Public Call Process, until its conclusion, with the signature of the transport service contract by the shippers interested in contracting transport capacity. However, it will be up to the authorized carrier (in this case, TBG) to carry out the process.


With the expiration of the TCQ Brasil Contract (Transportation Capacity Quantity) on 12/31/2019, approximately 18 million cubic meters per day of transport capacity were released on Gasbol. Therefore, ANP Public Call No. 01/2019 was carried out with a view to contracting the available transport capacity for the years 2020 to 2024. Public Call No. 02/2020 continued the process of hiring Gasbol's capacity, covering the period from 2021 to 2025, and Public Call No. 03/2021 covers the period between 2022 and 2026.


Since there was not enough time for the end of the public call process still in 2021, the ANP approved the extraordinary contracting by TBG. This Public Call process will replace the extraordinary contract, also in the firm modality, on an annual basis from 2022 to 2026.


Based on the sole paragraph of Art. 38 of ANP Resolution No. 11, of March 16, 2016, the ANP will publish in the Federal Official Gazette (DOU) the notice of approval of the Public Call notice to be carried out by the carrier in a manner indirect. The terms of the approved public notice can only be changed with the prior and express approval of the ANP.


The documents will be made available on the ANP website, on the Public Calls page (https://www.gov.br/anp/pt-br/assuntos/movimentacao-estocagem-e-comercializacao-de-gas-natural/transporte-de- natural-gas/public-calls), and on the TBG website.
