The ANP Board of Directors approved today (7/7) the resolution that revises ANP Ordinance No. 251/2000, concerning the regulation of non-discriminatory access, by interested third parties, to waterway terminals, existing or to be built, for the movement of oil, their derivatives and biofuels. Free access to waterway terminals is a legal determination that aims at equality in the use of entry facilities for imported liquid products or transported by cabotage along the Brazilian coast.

 

The suggestions received during the public consultation and at the public hearing on the new regulation were evaluated by the technical area and the final text underwent legal analysis by the Federal Prosecutor's Office with the ANP, to then be submitted to the Agency's collegiate board.

 

The review process of ANP Ordinance No. 251/2000 involved carrying out a prior consultation in 2016, in addition to debates from 2017 to 2019. In 2020, public consultation and hearing were held proposing the revision of the ordinance. The large amount of contributions, criticisms and suggestions received led the ANP to hold workshops and individual meetings with economic agents, and, as a result, to prepare the draft resolution that gave rise to the resolution approved today by the ANP board.

 

The text of the new resolution will be available after its publication in the Official Gazette.
