The ANP publishes a dynamic panel with data on exemptions and adjustments to local content commitments, which are the commitments assumed by companies, in oil and gas exploration and production contracts, to contract a minimum percentage of national goods and services.
In 2018, the ANP regulated, with ANP Resolution No. 726/2018 (http://legislacao.anp.gov.br/?path=legislacao-anp/resol-anp/2018/abril&item=res-726-2019), the criteria, requirements and procedures applicable to the contractual exemption and adjustment provisions for local content commitments.
Thus, the Dynamic Panel for Exemption and Adjustment of Local Content provides information on all requests for exemption from compliance or adjustment of local content commitments filed with the ANP, applicable to the exploration phase or the development stage of contract production. The tool allows to consult and cross information, filtering by operator, block / field, environment (sea or land) and the current situation of the corresponding order.
The database will be updated as the status of orders changes.
Exemption and adjustment of local content
The exemption is the possibility of exemption from local content for specific contracts for goods or services, authorized exceptionally, due to the absence of a national supplier, excessive price and / or term characterization and / or use of new technology not available in the country .Adjustment, on the other hand, is a mechanism that allows the revision of the percentage applicable to a certain item or sub-item, offset by expenses incurred above that committed to other items of equal economic relevance, authorized on an exceptional basis and based on the public interest.
The exemption or adjustment provision is established only for the contracts from the 7th to the 13th Bidding Rounds in the concession regime, of the Transfer of Rights Surplus Round, of the 1st Production Sharing Round, in addition to the contract of the 2nd Production Sharing Round referring to the unitizable area adjacent to Gato do Mato.
ANP Resolution No. 726/2018 also allowed operators to add the local content clause, changing the percentages committed to those authorized by the National Energy Policy Council (CNPE) as of the 14th Bidding Round. For the added contracts, the possibility of exemption or adjustment was eliminated. Thus, the requests for exemption and adjustment previously formulated for the added contracts were automatically extinguished and the respective request filed for the contract phase (exploration phase and / or the development phase) reached by the amendment
