The ANP Board approved yesterday (5/27) the forwarding to the Ministry of Mines and Energy of the pre-public notice and of the minutes of the production sharing contracts in the areas of Sepia and Atapu, of the 2nd Bidding Round of Excess Volumes of the Transfer of Rights, scheduled for December this year. The two areas, located in the Santos Basin, were not purchased in the Bidding Round for the Surplus of the Transfer of Rights, held in November 2019.
The guidelines for the 2nd Bidding Round for Excessive Volumes of Transfer of Rights are provided for in CNPE Resolution No. 3/2021, which sought to bring more predictability, attractiveness and competitiveness to the new round, in order to guarantee the best result for the Union.
CNPE Resolution 05/2021 authorized the holding of the round by the ANP and established the technical and economic parameters for the establishment of the subscription bonus and minimum oil percentage for the Union. The values of the subscription bonuses (amounts paid by companies for signing of the contract) will be R$ 7.13 billion for Sepia and R $ 4 billion for Atapu. The minimum percentages of the Union oil surplus will be: for the Sépia field, 15.02% and for Atapu, 5.89%.
To make the 2nd Round of Surplus feasible, MME Ordinance No. 08 was also published, with guidelines for calculating the compensation due to Petrobras for the investments made in the Sépia and Atapu fields.
Petrobras sent a letter to the Ministry of Mines and Energy expressing its interest in exercising its preemptive right to operate and participate in relation to the Sépia and Atapu areas, both with a 30% participation percentage, which should be included in the bidding documents for the 2nd Round , as provided for in CNPE Resolution No. 09/2021.
