Petrobras and FUP signed the Collective Labor Agreement (ACT) in person at the Company's Headquarters. For bases where the agreement was not signed, a gradual transition to labor legislation began on 9/15.

 

The unions of the Single Federation of Oil Workers (FUP) concluded the assemblies of all their bases with approval of the proposed Collective Labor Agreement 2020/2022. On Wednesday, 09/16, representatives from Petrobras and FUP formalized the agreement with a face-to-face signature at the Company's Headquarters Building (Edise). All those present followed the sanitary protocol required to access the building, with testing, wearing masks and minimum distance.

 

ACT 2020/2022, closed at the negotiating table, preserves the vast majority of the terms of the previous ACT. In addition, the ACT will be valid for two years, until August 2022, with the guarantee of not being dismissed without just cause during its term.

 

At the bases of the Sindipetros of Pará, Amazonas, Maranhão and Amapá, Rio de Janeiro, São José dos Campos, Sergipe and Alagoas and the Litoral Paulista, where the agreement was not approved, a gradual transition to labor legislation began for employees who have not signed the Individual Labor Agreement (AIT). The nine changes implemented since 9/15 for base employees who have not signed the agreement and have not joined the AIT are as follows:

 

- Vacation Bonus: only 1/3, according to legislation 

- Additional for Time of Service (ATS / Anuênio): freeze the table, ending the progression 

- Educational Benefits: allow new enrollments only for daycare and preschool. Current enrollments for other benefits (elementary and high school) will only be maintained until December 2020 in respect of the school year. 

- Overtime: end of overtime at 100%, payment according to legislation 

- Overtime shift change (HETT): end of HETT at 75%, payment according to legislation. 

- Additional stay in the State of Amazonas: discontinuity. 

- Land Field Bonus: discontinuity. 

- Holiday Shift: discontinuity. 

- Union Releases: according to article 543 of the CLT, with total cost to the union.

 

A possible alternative for maintaining the benefits and advantages for employees of bases where the company's last proposal was not approved is AIT. To be eligible, the employee must have a college degree and a monthly salary equal to or higher than twice the maximum Social Security benefits limit. The criteria are provided for in legislation. The duration, benefits and advantages of the AIT are the same as ACT 2020-2022, including the job security clause (no unfair dismissal until August / 2022).

 

The adhesions to the AIT by the employees of the bases of the five unions not affiliated to the FUP already represent about seven thousand signatures. The sum of the employees of the FUP bases, where the agreement has already been signed, with the employees who joined the AIT in the bases of the other five unions, represents 65% of the total employees of the company with the benefits and advantages of ACT 2020/2022.
