Ministry of Mines and Energy (MME) is evaluating the impacts arising from the Normative Resolution of the National Electric Energy Agency (Aneel) No. 1.030/2022, of July 26, 2022, on the procedures and methodologies for the calculation and annual review of the amounts of physical guarantees of energy from wind farms, based on verified electricity generation, established by MME Ordinance No. 416, of September 1, 2015.

The ordinance defines that, during the review of the physical guarantee based on the electricity generation verified, the MME may exclude from the calculations certain periods of unavailability resulting from systemic restrictions or third-party causes (constrained-off events) duly recognized by Aneel.

As part of this agency's attribution, Aneel Normative Resolution No. 1,030/2022 began to establish the procedures and criteria for determining and paying for operating restrictions due to constrained-off of wind farms. The resolution brings, among other things, the conceptual definition of constrained-off restrictions in wind farms, the classification of events, the scope regarding the modality of dispatch of the plants, the way of calculating the energy not supplied, the way of payment for the constrained-off events as well as payers.

In this way, the amounts of physical energy guarantees of wind farms based on verified electricity generation, which, pursuant to MME Ordinance No. 416/2015, must be published by September 30 of each year, they will exceptionally be published until November 2022, after evaluating the impacts arising from Aneel Normative Resolution No. 1030/2022 in the aforementioned Ordinance.

With this measure, the MME aims to ensure that MME Ordinance No. 416/2015 is in tune with the precepts of the Aneel Resolution, in order to strengthen the business environment, ensuring transparency, predictability and security in the electricity sector.

Physical guarantee of energy from solar and thermal biomass plants with zero CVU based on verified generation

The Ministry of Mines and Energy (MME) published in the Official Gazette (DOU), this Friday (30/09), the ordinances that define the calculation and annual review of the amounts of physical guarantees of energy of thermoelectric plants (UTEs). ) biomass with null Variable Unit Cost (CVU) based on verified electricity generation, in accordance with MME Ordinance No. 564, of October 17, 2014.

The ordinances that define the calculation and annual review of the amounts of physical energy guarantees of photovoltaic solar plants were also published based on verified electricity generation, in accordance with MME Ordinance No. 60, of February 21, 2020.

The publications are in line with the MME's premise of guaranteeing predictability in order to provide transparent signals to the market, strengthening the business environment.
