The ANP started today (9/14) the 45-day public consultation on the amendment to ANP Resolution No. 837/2021, which regulates the nomination of areas by legal entities in the oil and natural gas industry. The public hearing on the subject will be held on 11/8/2021.
With the nomination process, companies can suggest oil and gas exploration and production areas of interest, for study by the ANP, in order to include them in the future in a bidding round or in the Permanent Offer.
In the current form of the resolution, only companies incorporated under Brazilian law can carry out this procedure. The ANP's proposal is that this rule be changed to include the possibility of nomination by legal entities incorporated under foreign laws.
With this possibility, the ANP seeks greater plurality in the participation of actors in the oil and natural gas industry, since it will encourage the suggestion of areas to be studied by the ANP.
The revision does not change the need for companies to be incorporated under Brazilian law to enroll in bidding rounds or in the Permanent Offer. In other words, even if the areas nominated by foreign companies come to make up a future round, these agents will need to adapt to this norm in order to enroll in the event.
