Firjan Welcomes the Presidential Vetoes to the "Jabutis" in the Offshore Wind Legal Framework

The Federation of Industries of the State of Rio de Janeiro (Firjan) celebrates the presidential sanction of Law 15,097, an important step in structuring the foundations of the new market and of great significance in the energy transition process.

The Federation of Industries of the State of Rio de Janeiro (Firjan) celebrates the presidential sanction of Law 15,097, resulting from Bill 576 of 2021, which establishes the legal framework for electricity generation in offshore environments. According to the federation, this is an important step in structuring the foundations of a new market being developed in the country, particularly for offshore wind energy generation, a technology with high potential in Brazil and significant relevance in the energy transition process.

Rio de Janeiro stands out as one of the leading states with potential for offshore wind energy, with a solid industrial and services base built over nearly five decades of offshore oil and gas market operations. In addition, the state has 16 projects in the environmental licensing process with IBAMA, reinforcing its strategic position in the development of this new market.

Firjan and the industries in the state of Rio have been actively involved in discussions related to offshore energy, collaborating with the state and federal governments, highlighting the economic and environmental benefits of advancing this sector. The federation also views the presidential vetoes to the so-called "jabutis" – provisions inserted into the law with no direct relation to its main purpose – as an important achievement, bringing benefits to the emerging market.

Some of the vetoed provisions include: the renewal of coal-fired thermoelectric plant contracts until 2050, a source of energy that emits more than twice the amount of CO₂ compared to natural gas; the expansion of the contracting of small hydropower plants (PCHs) to 4.9 GW through reserve auctions; a halving of the volume of thermoelectrics to be contracted, with the inclusion of mechanisms that could raise the price of gas for supplying these plants; and the extension of the deadline for the start of operation of solar distributed generation projects with signed distribution system usage contracts.

The removal of these provisions reflects progress in favor of the decarbonization of the energy matrix and the reduction of charges for consumers, a commitment that the federation values, defends, and hopes will be maintained when reviewed by the National Congress.

Firjan remains committed to supporting the sustainable development of Brazil's energy sector and reiterates its readiness to collaborate with the government and other stakeholders involved in implementing this new legislation, ensuring that the offshore market prospers and contributes significantly to Brazil's economic growth and energy transition and integration.
